Enactment of the Law on the Special Lease Regime for Residential Properties
On August 07, 2026, the Law on the Special Lease Regime for Residential Properties (Ley del Régimen Especial de Arrendamiento de Inmuebles Destinados a Vivienda) was published in Extraordinary Official Gazette No. 7,065, made available today.
This new legislation applies exclusively to residential lease agreements executed after its entry into force, leaving pre-existing lease relationships governed by the prior legal framework.
Among its main features, the law re-establishes party autonomy to set contractual terms and rent amounts (permitting foreign currency indexing), caps security deposits at up to three months’ rent, and promotes alternative dispute resolution mechanisms.
Pursuant to its final provision, this law comes into force immediately upon its publication in the Official Gazette.
